These Terms of Service cover the Online Presence Concierge client portal only. They apply alongside, and do not replace, your signed Concierge Service Agreement. Where the two ever conflict, the signed Service Agreement controls. Specific dollar figures, the liability cap, and termination terms are defined there, not restated here, to avoid two documents quoting different numbers.
1. Acceptance of Terms
By accessing or using the Online Presence Concierge client portal, you agree to these Terms. If you do not agree, do not use the portal.
2. Description of Service
Senior Media Group LLC operates the Online Presence Concierge client portal for professionals who have signed a Concierge Service Agreement. The portal provides access to your AI-answered call summaries, lead and contact records, scheduling tools, and review-request activity, and lets you trigger certain actions manually (such as a manual review request).
3. Client Responsibilities
- You are responsible for the accuracy of the business information you provide (business name, hours, callback preferences, and similar details used to configure your AI answering service).
- You are responsible for your own compliance with call-recording, telemarketing, and data privacy laws applicable to your business and the callers you serve, including any required notice or consent for call recording under the laws of the states where you operate or where your callers are located.
- You are responsible for keeping your portal login credentials secure and for any activity under your account.
4. Payment and Subscription Terms
Payment terms, including setup fees, recurring billing, and cancellation, are governed by your signed Concierge Service Agreement, not restated here to avoid any conflict between the two documents. If you have billing questions, contact us directly.
5. No Guarantee of Results
The Concierge service is a call-answering, lead-capture, and follow-up tool. We do not guarantee any specific number of leads, conversions, appointments, or business outcomes. Results depend on factors outside our control, including your market, responsiveness, and how leads are ultimately handled once they reach you.
6. User Conduct
You agree not to:
- Use the portal for any unlawful purpose
- Attempt to interfere with or disrupt the portal or its underlying infrastructure
- Share your login credentials with unauthorized users
- Use the AI answering service to record calls without providing legally required notice or obtaining consent from callers where applicable
We may suspend portal access for violations of these Terms.
7. Intellectual Property
The portal, its underlying software, and Senior Media Group's own branding are the property of Senior Media Group LLC and its licensors (including GoHighLevel/HighLevel Inc. as the underlying platform provider). Your own business data, call recordings, and leads remain yours.
8. Disclaimer of Warranties
The portal is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free, and we do not warrant the accuracy of AI-generated call transcripts or summaries.
9. Limitation of Liability
Liability is limited as further set out in your signed Concierge Service Agreement. To the extent not addressed there, to the fullest extent permitted by law, Senior Media Group LLC and its members, officers, and employees are not liable for indirect, incidental, or consequential damages arising from your use of the portal.
10. Indemnification
You agree to indemnify Senior Media Group LLC against claims arising from your use of the portal, your violation of these Terms, or your failure to comply with call-recording, consent, or privacy laws applicable to your own business's use of the AI answering service.
11. Governing Law
These Terms are governed by the laws of the State of Texas. Disputes are resolved in the courts of Texas.
